The interaction between climate change obligations and international arbitration

The focus of this event will be on the interaction/tension between climate change obligations and investment treaty and commercial arbitration.The Urgenda case before the Dutch courts, the potential investment arbitration case against the Netherlands for the closure of relatively new coal-fired power stations and the recent judgment of the UK Court of Appeals regarding the third runaway at Heathrow illustrate how the obligations arising out of the Paris Agreement play out in legal proceedings. 

The structure of the event is as follows: After an introductory keynote by Wendy J. Miles, QC, which will provide a tour d’horizon, the panel discussion in the first part will address procedural issues, whereas the second part will focus on substantive issues.
